Do you remember …?
Back in 2017, the Liberal Government ended the subclass 457 Temporary Work (skilled) visa programme and replaced it with something very similar, just a little bit more difficult to deal with! This was known as the subclass 482 (Temporary Skill Shortage) visa programme.
Now, in 2024, it appears that the Labour Government wishes to do the same. That Temporary Skills Shortage visa programme will be replaced, fortunately not overnight as it happened back in 2017 but in the next couple of months, by the Skills in Demand visa programme.
This new visa will have 3 streams:
• Specialist Skills stream – this stream will be for visa applicants whose annual salary is above $135,000. There will be no specific list of occupations eligible for this visa but trades occupations will be excluded. There will be 3000 places available for this stream each financial year.
• Core Skills – this is similar to the current subclass 482 visa and there will be a new list of occupations – The Core Skills Occupation List (“CSOL”).
• Essential Skills pathway – this will cover workers with essential skills such as aged care workers.
This new Skills in Demand visa will be granted for up to four years. Labour Market Testing will be valid for six months rather than the current four months. Visa applicants will need to demonstrate at least one year of relevant work experience rather than the current two years.
The changes relating to finding a new employer which were brought in earlier this year remain in place and another benefit for the visa holder is that they will not be required to work for the same employer for two years to then be eligible for permanent residence.
Finally, the Skilling Australians Fund (“SAF”) levy is here to stay. However, we are assured that it will be a lot more straightforward for employers to apply for refunds when required.
