Good news for temporary visa holders! Recent changes may allow you to apply for permanent residency when this was previously not an option.
The subclass 482 Temporary Skill Shortage (Short-term Stream) visa (“TSS visa”) is open to applicants who are sponsored to work in an occupation listed on the Short-term Skilled Occupation List (“STSOL”). It typically allows for the visa holder to work in Australia for up to three two-year periods for their sponsoring employer.
So what has changed?
From 1 July 2022, eligible holders of a TSS visa can apply for permanent residency to enable them to live, work and study in Australia indefinitely, sponsor eligible family members to come to Australia and apply for Australian citizenship, once eligible.
Eligible TSS visa holders will be able to apply through the subclass 186 Employer Nomination Scheme “(ENS”) Temporary Residence Transition (“TRT”) stream. This pathway will only be accessible until 30 June 2024.
Who is eligible?
Not all TSS visa holders on STSOL occupations will be eligible to apply for the subclass 186 ENS/TRT visa. To be eligible, applicants must:
- have been working in Australia on a TSS visa for at least one year between 1 February 2020 and 14 December 2021;
- usually, must have worked for their sponsor for at least three years full time while holding the TSS visa in the four years prior to nominating you for the subclass 186 ENS/TRT visa; and
- meet the other relevant eligibility criteria.
This means that new TSS applicants may not be able to meet the eligibility requirements before access to this pathway is due to end on 30 June 2024.
