Do I need to stay working for my sponsoring employer ?

When you are granted a subclass 482 visa, there is usually a Condition – 8607 – that is attached to your visa which states that you can only work for your sponsoring employer. This condition also requires you to work in the occupation that was nominated for you.

However, should the employer/employee relationship breakdown for whatever reason and you find yourself out of a job, then you will find, in that condition on your visa, a period of time that you have to find a new employer that is willing to sponsor you, should you wish to remain in Australia.

The Condition 8607 has recently been updated to permit that, if your employment with your sponsoring employer ends, you can stop working or work outside of the above conditions for a limited time:

• Up to 180 days in a single period
• Up to 365 days in total across the period your visa is granted for.

These time periods start from 1 July 2024. They do not include any earlier periods of time when you stopped working under the condition in place before that date.

To go back to the original question, the answer is no, you are not required to stay working with your sponsoring employer. However, to be able to remain in Australia on your current subclass 482 visa, you would need to find a suitable employer who also is willing and able to sponsor you on your subclass 482 visa.
